ever consider that people might know what's going on, and that they didn't find out from you?

But I actually agree he should be offered, but not right now, if he wants to come to BYU should ask him to stay out of trouble for a few months and then extend the offer. If he really is interested in BYU at all this should not be that big of an issue for him.
