Two big problems I see:
1. Where was this article a month or so ago when the discussion was about Tukuafua? Seems like biased journalism to bring it up only when it targets BYU. He says in the article that it's not a criticism of BYU, but keeps bringing up BYU as being in the position of denying the transfer.
2. There is no indication anywhere that BYU is keeping Bernard from transferring. The only data we have is that FB has been suspended and discussions about his future are in process. PK seems to be taking a shot at BYU with no evidence that BYU has withheld anything. He even admits that FB "has not publicly declared any intention to transfer" so why is this an issue at all at this point.

I happen to agree with you and him that if FB or other athletes want to transfer they should be able to. But the timing and direction of this article are suspicious, at best. Take it up when there is a clear case of a problem (like Tukuafua) not when there may be no issue at all.
