Only the one that was involved with allowing a "friend" access to our check stock and writing a few checks (about $32k) has been denied. It appears that UT Unemployment is more afraid, like you mention, of having things taken to court or whatever, that they are being very lenient in allowing these individuals to collect unemployment. Utah had had the reputation of being a state where they were more sticklers on people being fired to be able to collect unemployment, but that hasn't been my experience over the last year.
Maybe you do like a lot of government or school districts do and put him on administrative leave. If he has no annual leave/PTO available, that he does it without pay. He definitely cannot be allowed to use company vehicles as that is a far bigger liability exposure to you and your company.
There just doesn't seem to be a perfect answer.
