The BYU fan wasn’t. He was filming people several rows behind them. He had no
idea the Whittinghams were nearby or even what they looked like. He hadn’t even seen the little girl crying until after Whitt’s son ripped his phone out of his hands and threw it into the stands.
It was entirely instigated by the Whittingams. Whit even bought the guy a new phone in exchange for him telling the police not to pursue referring the matter to prosecutors.
