Yes that is just negotiation. I shouldn't have said scare tactic. That was wrong
It actually is a clumsy/poorly drafted attempt at stating their position on paying a realtor's commission. In the end, it is up for negotiation and the party that has the leverage will win.
Either way, get a lawyer over a realtor if buying from a builder. Cheaper and better. You can get attorneys for a flat rate under $1000 as low as $500 I think
