It depends on what you have a duty to disclose under Utah law. If there is no
specific duty to disclose, you can still go for run of the mill fraud if he can show that they made representations to him. If they were savy about it, they probably didn't. Small claims is generally like judge judy, no rules of evidence or procedure, you just make your case. If you lay out the fact that they knew about this and said nothing, you probably win. Worth a shot anyway.
