From the OP's sited article:
This could also be part of the “Shamrock Series” branding, even if it’s BYU’s “home game” (much like Wisconsin this upcoming season). There could be service opportunities, masses and other Alumni Association functions around the game, led by the 300-strong Notre Dame Club of Las Vegas.
This to me seems like a No-Go. Look at the branding for the 2021 Shamrock series. It screams Notre Dame (just by being called the Shamrock Series), even though it is technically a Wisconsin home game.
The contract should stipulate that this is not a Shamrock Series game, forbiding the branding as such. If it's our "home" game, we should call it the Las Vegas Cougar Classic, or something of the sort. As a home game, BYU should get 100% of the revenue, and ND can take the $1M they owe us for not playing in Provo to travel to the game, thus not requiring a BYU payout to ND. Won't happen, but that is what should happen. Why should a contractually-obligated away game (that from TH's own words, they have been dodging..."crickets for years") be profitable to Notre Dame?
