The government didn't pay anybody. The normal bankruptcy process produced plenty
to pay everyone. That's because mostly the assets weren't stolen and used for personal benefit, contrary to the claims of the prosecutors. They were put in risky and illiquid investments by a related company. That is a problem but it is not the same problem as a simple Bernie Madoff ponzi scheme, and yes the punishment should therefore be different.
