that BYU is free to negotiate with whom they want.

And they have. A private contract with ESPN, contract with several bowls and contracts for H/H series with P5 schools.

We were also free to make the decision to become independent. Just because the landscape has changed (CFP, realignment and huge P5 TV contracts) is not grounds for legal action. BYU is free to embark on any course it believes best serves its interest, including pursuing admission to a P5 conference. We just can't force any conference to embrace our overtures.
