You apparently missed the part in the OP where Stanton said (parphrased)

"back off until I can move over safely so you can speed." That's EXACTLY what the law says, the slower driver in the left lane needs to move over SAFELY.

So, Stanton was requesting that the speeding driver give him an opportunity to fully comply with the law.

I can't see a cop failing to give a ticket to the tailgater, regardless of whether or not he gives a ticket to the slow driver.
