The NCAA vs Okla case was about television rights, not one group excluding
another. The NCAA said it should control all tv contracts. Oklahoma wanted to negotiate their own
TV deals.

The NCAA lost. Then the college's formed a separate organization to negotiate TV on/in their behalf.

That is why, today, there all multiple networks with different agreements with networks. Notre Dame
even signed with NBC to air all home games in, basically, Prime time. UT formed it’s own network. Since then, most of the P5 conferences have formed their own networks. BYU has it’s own network, though not exclusively for sports.

No one dictates that The Longhorn Network or BYUTV must give equal access to other Div. members. Since UT is in the Big12, the conference and the school determine scheduling. Since BYU close to be unaligned, it has sole control of scheduling.

Regarding Notre Dame independence vs BYU ind. ND has been Indy for 100 years. BYU for +/- ten.
Liberty for 4 or 5. Notre Dame saw the handwriting on the wall and made a scheduling agreement with the ACC. They are “independent”, but have a relationship with a P5 conference. BYU and Liberty
do not.

If the P5 conferences want to separate, BYU has no more leverage than Liberty.

BYU contends that because of it’s large LDS “fan base”, it should be automatically included. If Liberty said that it’s even larger “fan base” of Evangelicals should mean inclusion, is that valid? Should Dallas Baptist apply for the same reason?
