The EEOC has no real authority, but they try to arbitrate between the two parties. Not like a normal arbitration, but a negotiation arbitration.

The alternative would be to go ahead and fight it. If a case has no merits, fight it and win at sum. judgment

Problem is that these cases are generally filed in federal court. Federal Courts don't generally award fees that often.
