Many countries are loser pays. The US decided that structure would reduce the poor’s likelihood of seeking justice.

Plaintiff lawyers love a loser pays system. It actually encourages frivolous lawsuits

Nothing dishonest about it. The lawyer has a duty to his client and must prepare the case for trial. That costs
