Interesting issue. It does seem overly punitive for the loser to always pay 100%
As you said, that would disproportionately help the rich and hurt the poor. OTOH, this country does need to discourage wasteful, frivolous lawsuits.
How about a compromise, something like loser pays 50%, but the judge has discretion to adjust this upward or down, depending on the merits of the case?

Many countries are loser pays. The US decided that structure would reduce the poor’s likelihood of seeking justice.
