Loser pay creates a cottage industry of overbilled small lawsuits.
For example, a technical violation that you know will win but should probably never be filed. Suddenly if the lawyer fees are paid by loser rack up the hours because the other guy is paying. Like a small ADA violation against a mom and pop operation.

Many countries are loser pays. The US decided that structure would reduce the poor’s likelihood of seeking justice.
