Either pay him or be ready to back up your claim that his work was not worth
the $500 he is owed.

His criminal / immigration status has nothing to do with your agreement. Heck, even if he's imprisoned or deported he could ostensibly sue you for work performed.

On the moral side of things, I think I come down where everyone else does too--pay him for his time and don't try to cheap out because of ancillary matters. Your relationship with him is all that matters.
