So, he's either U-turning, or pulling into a business or something?

If that's the case, then the fault is split 50/50... If you are turning, you need to make sure the coast is clear so he is at fault for turning into oncoming traffic. But, the guy who almost hit him is also at fault for improper use of a turn only lane.
