On the one hand, it would seem this method implies premeditating to hurt/kill someone else
in order to kill yourself but I'm not sure that qualifies as 1st degree under the law. But the primary intent is to kill yourself and people like that are most likely deeply depressed and have some measure of diminished capacity (again I don't know if that means the same thing the law means on that term).
Long story short, I don't view this as 1st degree. Just very, very wrong and very, very sad. 2nd degree would seem to meet the need for justice.
