Cutting a piece of video is not a derivative work. Maybe if you made a video...
...from the video itself (like used a video camera to record your tv) and then cut that, you might be able to sell it - and I even question that. That's why there is a disclaimer with every television production telling you that you can't sell, distribute, etc. any part of the broadcast without exclusive rights from those involved and that have ownership of the broadcast. Your example is more like someone taking a picture of the Empire State Building at sunset and selling it, which is perfectly fine.
