He isn't contesting the initial transaction, it's the extreme discounting that may continue through several games.

This destroys future incentive, (let alone bother the heck out of early consumers), not an initial contractual obligation.

Customer Service 101. BYU should bite the bullet and refund people in those sections, or give discounts on the next season's tickets.

Cost of retaining existing customers is always far lower than acquiring new ones.
