I think he's saying it's a policy rather than a commandment. IOW, there is
currently a policy that keeps those who smoke or drink from getting a temple recommend. They're not kept out for not following commandments like loving your neighbor or not lying, but for violating a policy. A similar argument has been put forth to explain why people of African descent were not issued temple recommends or ordained to the priesthood for so long -- it was a policy, not a commandment.

At least I think this is the case he is making.
