If paternity is covered under FMLA,
Then I’m not sure this is ethical, or perhaps even legal. Company A will file an FMLA claim for the paternity leave. Some portion of that leave will then be paid by their policy covering such claims. If an employee starts working at Company B during any of the period being paid by the policy, then that’s where things get sticky.

But I cold be wrong.
