This is a ridiculous (and wrong) analogy as there is actually an equivalent - negligent discharge of a firearm, and the
penalty really isn't that different. You need to quit digging in your heels. Would your opinion change if he hit a person instead of a concrete barrier? He's lucky he didn't, but he easily could have.
