But their own actions were clearly a factor. To say otherwise is simply being disingenuous. If two people get into a car accident because someone runs a red light, while the other person wasn't wearing their seat belt, clearly the blame falls on the driver who ran the red light. But that doesn't mean the failure to wear a seat belt didn't factor into the extent of the injuries. Do you cite the person for not wearing the seat belt? No, that would be insensitive and minimizes the actions of the other driver. But it plays a factor nonetheless.
