Also, loser pays would be great for Plaintiffs. Roughly 90% of all medical malpractice never see the light of day because of costs involved. To get anywhere with a med. Mal case you need a doctor to review prior medical records and all medical records pertaining to the alleged negligence and then all the medical records thereafter so the expert physician can opine that the treating physician breached the standard of care, that that breach caused the plaintiff injuries and that there was not an intervening factor. That's $50k before anything is done. If a med Mal claim does not have a $200k potential, it's never brought. Loser pays. Awesome. Stick it to all the hospitals with these low value claims where their carrier will pay for Plaintiff's attorney and expert fees. Loser pays is the absolutely worst cost cutting suggestion out there.
