So, 1 it wasn't a penalty cross-check it was a shove, but even if you think it was a penalty, it wasn't the cross-check that caused the injury so it should not have been elevated to a 5 minute major.

My resolution would be, force referees to do a review of the penalty before issuing 5-minute majors.
