Completely disagree. The difference is foresight.
Medical Boards and State Bars anticipate that they will have members commit criminal acts, so they incorporate those standards into occupational standards. The NCAA never imagined that they would have to protect the public from programs associated with higher education, so criminal activity was not part of NCAA rules. But just because the NCAA lacked foresight in this case doesn't mean they shouldn't have the power to discipline a program for criminal actions.
