If he would have remained silent/called his lawyer, he would have been arrested/
detained and taken to a hospital. Once at the hospital, the officers would have obtained a warrant to obtain a blood draw. That likely occurred anyway once he was arrested. The field sobriety tests essentially provide additional probable cause to obtain the warrant for the blood draw which is what is primarily used to obtain conviction in court.
