Actually, I agree.
But I could see the HCO getting involved once the police are done doing their thing.
Let's face it - it is not uncommon for sexual assault to take place, but not be prosecuted due to a lack of evidence. That doesn't mean that the school shouldn't get involved in those situations and still kick a kid out if he puts other women at the school at potential risk.
